TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of desert-outlaw.com and purchases from Desert Outlaw LLC (“Desert Outlaw,” “we,” “us,” or “our”). By accessing our website, placing an order, or using our services, you agree to these Terms.

  1. ONLINE STORE TERMS

You must be legally capable of entering into a binding agreement to use this website or make a purchase. You may not use our products, website, or services for unlawful or unauthorized purposes.

You agree to provide current, complete, and accurate billing, shipping, contact, and payment information for all purchases.

  1. PRODUCTS AND PRODUCT INFORMATION

We sell apparel, accessories, stickers, sticker packs, and other lifestyle merchandise.

We make reasonable efforts to display product colors, artwork, sizing, placement, and other details accurately. Colors may appear differently depending on your screen or device. Minor variations in print color, size, texture, and placement may occur during production and are not necessarily defects.

Product descriptions, images, pricing, and availability may be corrected or updated at any time. We may discontinue or limit products without notice.

  1. PRICES AND PAYMENT

Prices are listed in U.S. dollars unless otherwise stated. Applicable taxes, shipping costs, and any other permitted charges will be shown before you complete checkout.

We may change prices at any time, but price changes will not affect orders already accepted unless an obvious pricing or technical error occurred.

Payment is processed through Shopify or another authorized payment provider. We do not directly store complete payment-card information.

  1. ORDERS

Submitting an order does not guarantee acceptance. We reserve the right to accept, reject, limit, or cancel an order for reasons including suspected fraud, incorrect pricing, product unavailability, inventory errors, payment issues, or violation of these Terms.

If we cancel a paid order, we will issue a refund for the canceled merchandise to the original payment method.

Order confirmations are sent to the email address provided during checkout. Customers are responsible for reviewing order details and contacting us promptly about errors.

  1. PREORDERS AND BACKORDERS

Certain products or sizes may be offered as preorders or backorders. These items are not ready for immediate shipment.

Estimated production and shipping timeframes are provided in good faith but are not guaranteed. Manufacturing, supply, carrier, or other delays may occur. If a material delay affects an order, we will provide notice and any options required by applicable law.

Payment terms, estimated availability, and other preorder or backorder details displayed on the product page, in the cart, or during checkout become part of your purchase agreement.

Orders containing both in-stock and preorder or backorder merchandise may be held until all items are ready. Customers may contact us to ask about separate shipping; additional shipping charges may apply.

Cancellation or modification requests should be submitted as soon as possible. Once production begins or an order has been committed to a production run, cancellation or modification may not be possible, subject to applicable law and our Purchase Options Cancellation Policy.

  1. LIMITED-RUN AND REQUEST-BASED PRODUCTS

Some designs may return only if a stated production threshold is reached. Joining an interest list or submitting a restock request does not create an order, reserve inventory, guarantee production, or result in a charge unless clearly stated otherwise.

If a required threshold is not reached, we may decide not to produce another run.

  1. SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms.

Delivery dates are estimates unless expressly stated otherwise. Desert Outlaw is not responsible for delays caused by carriers, weather, incorrect addresses, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

  1. RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, damaged-item claims, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

Nothing in these Terms limits any consumer rights that cannot legally be waived.

  1. PROMOTIONS AND DISCOUNTS

Promotions, discounts, and promotional codes may have separate conditions, expiration dates, product exclusions, or usage limits. Unless expressly stated otherwise, promotions cannot be combined, applied retroactively, transferred, or redeemed for cash.

We may modify or end a promotion as permitted by law.

  1. INTELLECTUAL PROPERTY

The Desert Outlaw name, logos, taglines, artwork, designs, product images, written content, graphics, and other brand materials are owned by or licensed to Desert Outlaw LLC and are protected by applicable intellectual-property laws.

You may not reproduce, sell, modify, distribute, publish, or commercially use our intellectual property without prior written permission.

  1. REVIEWS AND CUSTOMER CONTENT

If you submit a review, photograph, comment, testimonial, or other content, you confirm that you have the right to submit it and that it does not violate another person’s rights.

You grant Desert Outlaw a nonexclusive, worldwide, royalty-free license to display, reproduce, and use submitted content for operating and promoting the business. We may remove content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

  1. PROHIBITED USES

You may not:

• Use the website for unlawful, fraudulent, or abusive activity
• Attempt to interfere with website security or operation
• Upload malicious code or harmful material
• Scrape, copy, or commercially exploit website content without permission
• Infringe our rights or the rights of others
• Submit false information or impersonate another person
• Use the website to transmit spam or unauthorized solicitations

We may suspend or terminate access for prohibited conduct.

  1. THIRD-PARTY SERVICES AND LINKS

Our store is hosted by Shopify, and we may use third-party services for payments, shipping, reviews, communications, preorders, analytics, or other business functions.

Third-party websites and services may have their own terms and privacy practices. Desert Outlaw is not responsible for third-party content or services outside our control.

  1. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, or completely secure.

Products are subject to the express descriptions and policies provided at purchase. Nothing in this section excludes warranties or rights that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Desert Outlaw LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law. These limitations do not affect nonwaivable consumer rights.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Desert Outlaw LLC harmless from claims, losses, or expenses arising from your unlawful use of the website, your violation of these Terms, or your infringement of another party’s rights.

  1. SEVERABILITY

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

  1. WAIVER

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of California and applicable federal law, without limiting any mandatory consumer protections that apply to you.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time. Updated Terms will be posted on this website with a revised effective date. Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
